PETITION: The legal right to armed self defence in Australia

Post by Keith » Fri Sep 28, 2018 3:57 pm

Please sign this petition.
At this present time possessing any object specifically for the purpose of self-defence, lethal or non-lethal, is a criminal offence in Australia. There are many women, raped and/or murdered, who would have been liable to prosecution had they been carrying anything that might have saved them.

It is illegal for Licensed gun owners in Australia to use their firearm for self defence or for the defence of their family in an armed home invasion.

It should be a human right to be able to defend yourself against an armed assailant, or against a stronger unarmed assailant. Citizens should be legally able to carry either or both Pepper Spray or a Taser for defence. Gun owners should have the right to use their guns for self defence & for the defence of their family in an armed home invasion.

Feel that my country is treating me like a child not only can a person kill with many means in todays world it's not hard to make a firearms but in sure that there not going to be hard to find at the time I would invest in a good bow and knife and learning how to make weapons honestly the ones running around with guns are asking for it makes noise needs bullets there wont be space for the weak it's the man with magic hands that fashions his new world practice practice practice then that's right more practice till you are the weapon .

It is illegal for Licensed gun owners in Australia to use their firearm for self defence or for the defence of their family in an armed home invasion.
It is not illegal at all, in NSW at least, what is illegal is having a firearm ready for use in the home for defence.

One may use sufficient force to overcome an attacker, particularly if one believes that one's life is in danger, if the attack is with a firearm then it is legal to use a firearm to resist even to the point of lethality.

See:http://www.findlaw.com.au/articles/5022 ... ralia.aspx

This gives a general overview.

You are missing the point completely. In NSW it is illegal to carry ANYTHING for use in self defence, so basically no matter how young or old you are you can only use your hands & feet for defence.
In the home the same applies unless you are able to get your hands on a normal article in your house with which to defend yourself, then you will have to prove that this item was not actually kept for self defence.
Many aged people are not able to defend themselves against an attack from someone that is younger & fitter & perhaps stronger. If this attacker is armed with a knife or a club then your chances of survival are limited. You are not legally allowed to use a gun in such circumstances to protect yourself or others from harm.
What is it that you don't understand about the above?
Keith.

What I find hard to understand is that you have not familiarized yourself with the law.

Whilst it is illegal, as you say, to possess anything for the purpose of self defence it is not illegal to use anything for self defence if such defence is proved to be lawful.
